Christie, Parker & Hale LLP (CPH), one of Southern California's leading intellectual property law firms, announced today that the firm obtained another victory for its clients when United States District Court Judge, Manuel Real granted CPH's motion for summary judgment filed on behalf of a group of defendants sued for alleged patent infringement with respect to the manufacture and sale of blankets.
Patent holding company International Intellectual Management Corporation ("IIMC") asserted infringement of three patents by a number of defendants engaged in the import and sale of blankets, including CPH clients Lee Yunn Enterprises, Inc. (U.S.A.), American Jiamei Textile, Awad Manufacturing, Inc., Chung's Appliance, Inc., J.J.P, Inc., Kim's Home Center, Inc., L.A. Home Fashion, Inc., S & L, and Sung's Home Collection.
After CPH filed a motion for summary judgment, IIMC dropped any claim that one of the patents in suit was infringed. The Court granted summary judgment as to the remaining claims, sustaining all of CPH's objections to IIMC's expert testimony, and finding that Defendants had established they did not infringe any of the asserted patents.
"We are gratified that the Court granted our clients' motion," said CPH litigation partner Brian K. Brookey, who was lead counsel on the matter. "We believed from the beginning of the case that it never should have been brought, and are glad we were able to obtain a judgment in our clients' favor without the expense of going to trial." Brookey added that the next step in the case will be to seek an award of attorneys' fees from IIMC to compensate Defendants for their costs incurred in defending the matter.
