| Description | Further to the announcements dated 21 April 2011 and 25 April 2011 issued by Wilmar International Limited ("Wilmar"), Wilmar wishes to announce that its wholly-owned subsidiary, Wilmar Trading Pte Ltd ("WTPL") had filed an application to strike out the writ of summons filed by the plaintiff, Pacific Inter-Link Sdn Bhd ("PIL") on 29 April 2011. The hearing of WTPL's and the other 3 defendants' striking out applications proceeded at the High Court of Malaya at Shah Alam in Malaysia on 12 January 2012. On 10 February 2012, the High Court of Malaya at Shah Alam allowed WTPL's and the other 3 defendants' striking out applications with costs to be taxed. In a brief grounds of decision read out by the High Court Judge, upon considering the pleadings, cause papers and the written submissions filed by all parties and also upon hearing the oral submissions of all parties on 12 January 2012, the writ of summons and the statement of claim filed by PIL did not disclose a reasonable or sustainable cause of action. The Court also held that the cause of action filed by PIL is frivolous, vexatious and an abuse of the process of the court. PIL's writ of summons and statement of claim were ordered to be struck out with costs to be paid by PIL to all the defendants, including WTPL.
