Axtel, S.A.B. de C.V. (BMV: AXTELCPO; OTC: AXTLY) ("AXTEL" or "the Company"), a Mexican fixed-line integrated telecommunications company, today announced that with respect to the constitutional trial case between the Company and Operadora Unefon S.A. de C.V. ("Unefon"), Mexico's Supreme Court determined that the Ministry of Communications and Transportation ("SCT") did not possess the authority to review "calling-party-pays" interconnection rates established by the Federal Telecommunications Commission ("Cofetel") in 2007. Therefore, AXTEL's appeal of the Company's tariffs with Unefon for the 2005-2007 period must be reviewed and resolved by Cofetel once again.
This resolution does not imply any contingency, obligation or economic benefit for the Company as the applicable rates for such period must be resolved by Cofetel once again based on the applicable law.
