LONDON (Thomson Financial) - Anglogold Ashanti Ltd. said the Johannesburg High Court has ruled the exception lodged by the company in respect of former employee Thembekile Mankayi's claim for damages against the company has been upheld.
Mankayi had lodged a 2.7 million South African rand claim in respect of occupational lung disease allegedly sustained during his employment at AngloGold Ashanti's Vaal Reefs mine in the 1990s.
The finding confirms employees who qualify for benefits in respect of the Occupational Diseases in Mines and Works Act (ODMWA) may not, in addition, lodge civil claims against their employers in respect of their relevant conditions.
