JAWA Files Amended Complaint & Motion to Strike Citing Fraud by Verizon Wireless / Verizon Wireless Manipulated Photos in Complaint to Hide Important Information

SCOTTSDALE, Ariz., March 21, 2011 /PRNewswire/ -- Jawa, a Scottsdale company founded by Jason Hope and one of the fastest-growing companies in the Southwest, today filed an Amended Complaint against Verizon Wireless in the United States District Court for the District of Arizona. The new filing cites evidence of attempted fraud by Verizon Wireless, stating in part:

"The Verizon lawsuit purports to demonstrate deceptive Jawa web pages, but at least one of the screen shots depicted has been manipulated and distorted, effecting a fraud on the Court."

In a separate action, Jawa also filed a motion to strike the fraudulent allegations from the Complaint Verizon Wireless filed on March 7, 2011.

"It is outrageous that Verizon Wireless would sink so low to falsely manipulate our product and lie about our process," said Jawa Founder and CEO Jason Hope. "We follow the strict guidelines set by the Mobile Marketing Association when we deliver content to consumers. We adhere strictly to the 'double opt-in' process - the industry standard protocol that guarantees every customer knowingly agrees to sign up for any mobile service."

The court filings point out the fact that Jawa has conducted business with Verizon for over four years, during which time they received over $30,000,000 in fees from Jawa. Furthermore, Verizon Wireless has conducted extensive, comprehensive and sometimes abusive, audits of Jawa's products and process.

"They have been completely informed and are totally aware of the way our business has been run," Hope continued. "For Verizon Wireless to suddenly develop such amnesia and portray us as the scammers after they doctored evidence is indeed troubling. Verizon Wireless is behaving badly, not Jawa. They need to take a long look in the mirror."

Last week, a federal judge in Phoenix denied a motion by Verizon Wireless for an order that would have prevented Jawa from doing business with Verizon customers. "That was a big victory for our company," said Hope. "We knew all along that Verizon Wireless was trying to use its dominant market position to drive third party content providers like Jawa out of business, but we never imagined that they would so blatantly manipulate and distort the evidence to do so."

"Jawa creates hundreds of good jobs in our community. We are a responsible corporate citizen," Hope continued. "Verizon Wireless may try to distort the evidence, but they can't change the fact that our professionals are the best in the business."
