On 4 September 2026, the NSW Court of Appeal made orders vacating the hearing of the Appeals filed by the Rest Infrastructure Trust (REST Appeal) and the remainder of the Dexus Bloc (together, the Appeals) previously fixed for 20 October 2026. The Appeals have instead been fixed for hearing between 30 November and 2 December 2026, with an additional day available if required. Any appeal arising from the NSW Supreme Court's determination of the claims for costs and indemnity of APAC and the non-Dexus Bloc shareholders may also be heard together with the Appeals. The claims for costs and indemnity have now been listed for hearing before the NSW Supreme Court on 21 and 22 October 2026, instead of 9 September 2026. Dexus will provide further updates on the APAC matter in accordance with its disclosure obligations.
