As previously announced by engcon AB ("engcon" or the "Company"), the tiltrotator manufacturer Rototilt Group AB ("Rototilt") filed lawsuits against engcon and its subsidiaries (the "engcon companies") in September 2025 regarding alleged infringement of patented technology. According to the engcon companies, Rototilt's claims in the case concern the same matter as has already been adjudicated and was finally decided in favour of the engcon companies in a judgment by the Patent and Market Court of Appeal on 27 March 2025, in which the court found that the engcon companies had not committed patent infringement and dismissed Rototilt's action.
By decision issued today, the Patent and Market Court has, in line with the engcon companies' position, found that all of Rototilt's claims are covered by the previous judgment's binding effect. The court has therefore dismissed Rototilt's claims for patent infringement and injunctive relief in their entirety. A minor part of Rototilt's action relating to damages and corrective measures for the period after the date of the previous judgment, i.e. after 27 March 2025, has not been dismissed and has not yet been adjudicated.
The Patent and Market Court's decision to dismiss Rototilt's action in the above respects may be appealed to the Patent and Market Court of Appeal. Leave to appeal is required in the Patent and Market Court of Appeal.
