Sept 30 (Reuters) - Digital imaging company Presstek said International Trade Commission has determined that VIM Technologies Ltd. has been importing printing plates into the U.S. that infringe upon Presstek's patents.
ITC affirmed the July 24, 2009 decision of Administrative Law Judge James Gildea, who ruled that VIM has been infringing Presstek's legally protected rights, Presstek said.
This ruling should bring to an end VIM's illegal pirating of Presstek's valuable intellectual property in the United States, Presstek General Counsel James Van Horn said.
Presstek is also seeking an order requiring destruction of all illegal plates in the United States.
The company said, in April 2009, the Regional Court in Dusseldorf, Germany, found Presstek's European patents to be infringed by VIM's illegal plates.
The German court ordered VIM to cease all sales of infringing VIM printing plates, Presstek said, adding that although VIM has appealed this decision, it is confident it will prevail on appeal.
Presstek's shares were up 14 percent at $2.40 in extended trade. They had closed at $2.11 Wednesday on Nasdaq.
