CUPERTINO (dpa-AFX) - U.S. District Judge Lucy Koh Wednesday rejected Apple Inc.'s (AAPL) attempt for a permanent injunction against Samsung Electronics Co Ltd. (MSN.L, SSNNF.OB, SSNLF.OB) from selling products that infringe on the U.S. technology giant's certain patents.
Earlier this year, Apple won a $120 million verdict against Samsung regarding these patents, much less than the $2.2 billion it had sought, and requested to stop the South Korean company from selling smartphones and tablets that infringe on these patents.
Koh said in San Jose, California, that Apple did not satisfy 'its burden of demonstrating irreparable harm and linking that harm to Samsung's exploitation of any of Apple's three infringed patents.'
A Samsung spokesman welcomed the ruling, adding that the company remains committed to providing American consumers with a wide choice of innovative products.
Earlier this month, the two firms had agreed to abandon lawsuits against each other in countries outside the U.S., including the U.K., Australia, Japan, South Korea, Germany, Netherlands, France and Italy.
AAPL closed up 1.2 percent on Wednesday at $102.13.
Samsung is up 1.4 percent currently in Seoul at 1,248,000.00 Korean won.
