Phibro-Tech, Inc., a leading innovator and supplier to
the wood-treatment preservatives industry, today announced that it has
filed a patent infringement lawsuit against Osmose Holdings and Osmose
Inc. ("Osmose") for infringement of United States Patent number
6,753,035. This patent, which Phibro-Tech has exclusively licensed
from Michigan Technological University, deals with the groundbreaking
technology of micronizing a variety of additives, including additives
containing copper, and impregnating them into wood. The lawsuit was
filed in the United States District Court for the Eastern District of
Texas.
Phibro-Tech's previously initiated lawsuit against Osmose for Willful Misappropriation of Trade Secret, Tortious Interference With Prospective Economic Advantage, Breach of Contract, Unfair Competition, and Constructive Trust is scheduled for trial in New Jersey State Court January 8, 2007.
"While we regret that our action today is necessary, we intend to vigorously protect Phibro-Tech's wood-treatment intellectual property," said Dwight Glover, President of Phibro-Tech. "We believe that being aware of the issues raised by this lawsuit will allow customers to have the opportunity to make informed purchase decisions regarding their commitments, capital plans and continuity of supply."
