Arrow International and Johns Hopkins Awarded Judgment Against Datascope in Patent Litigation

READING, Pa., June 25 /PRNewswire-FirstCall/ -- A judgment was awarded to The Johns Hopkins University and Arrow International, Inc. in their patent infringement lawsuit against Datascope Corp. on Friday, June 15, 2007, in the United States District Court in Baltimore, Maryland. Johns Hopkins and Arrow had brought suit against Datascope for infringing patents relating to the Arrow-Trerotola(TM) Percutaneous Thrombolytic Device (PTD(R)), a device used by interventionalists for treating hemodialysis patients. The Baltimore jury found that the Datascope ProLumen device infringed three patents owned by Johns Hopkins and licensed by Arrow, and upheld their validity. The jury also awarded damages amounting to an 18% royalty on Datascope's sales of the infringing device. Johns Hopkins and Arrow have asked the court to issue a permanent injunction against Datascope's sales of the ProLumen.

Dr. Scott O. Trerotola, now with the University of Pennsylvania, invented the PTD as a device to clean clotted dialysis grafts in the early 1990's while working at Johns Hopkins. Arrow has an exclusive license for the technology, and has recently celebrated the ten year anniversary of the Arrow-Trerotola PTD. During this decade, tens of thousands of patients have been treated with the Arrow-Trerotola device.

Arrow's CEO Phil Fleck said, "We are pleased that the Court affirmed the Johns Hopkins and Arrow patent rights and expect continuing success with the Arrow-Trerotola PTD."

Johns Hopkins and Arrow were represented by Kenneth George, Ira Silfin, Marc Jason, and Rebecca Eisenberg of Amster, Rothstein & Ebenstein LLP, an intellectual property law firm in New York.
