Hexion Specialty Chemicals, Inc. announced today developments in its action in the Supreme Court of the State of New York against affiliates of Credit Suisse and Deutsche Bank (New York County Index No. 114552/08) for alleged breaches of their obligations under the financing commitment letter to fund the closing of the Hexion-Huntsman merger. The court today denied Hexion's motion for a temporary restraining order and preliminary injunction extending the expiration of the financing commitment letter pending the trial of Hexion's claims.
The court's decision today resolved a procedural question raised by Hexion to further protect its ability to secure effective relief against the banks if it prevails at a trial on the merits. Hexion requested and obtained from the court a case management conference, scheduled for this Monday, November 3, to consider next steps toward a trial on the merits of Hexion's claims for relief against the banks, including Hexion's request for specific performance of the banks' financing obligations.
