New Federal Labor Law Poster Deadline Is Nov. 14
The Poster Compliance Center Research Department advises U.S. employers that a new National Labor Relations Act (NLRA) poster will be required for most private-sector employers by Nov. 14, 2011.
The NLRA poster requirement became official when the National Labor Relations Board (NLRB) issued a Final Rule Aug. 25 requiring private employers to post a new federal labor law poster notifying employees of their rights under the NLRA.
The NLRB will issue the new poster on or before Nov. 1.
New NLRA Poster Similar to NLRA Poster for Federal Contractors
The new NLRA poster is similar to one which has been required for federal contractors since June 2010 by the U.S. Department of Labor. Federal contractors who already post the NLRA poster are considered to be in compliance with the new Final Rule.
The new poster is required for both union and non-union workplaces as NLRA rights apply to both, according to the NLRB.
The new NLRA poster requirement applies to nearly all private-sector employers subject to the NLRA, which excludes agricultural, railroad and airline employers. The NLRB also agreed to exempt the U.S. Postal Service.
"Very small employers" do not need to post the new poster, according to the Final Rule. These include retail businesses with a gross annual volume of business less than $500,000, or nonretail businesses with less than $50,000 sold out of state or purchased from out of state.
In addition to physical posting, employers must also post the notice on an intranet or internet site if personnel rules and policies are customarily posted there.
Translated posters will be required at workplaces where at least 20 percent of employees are not proficient in English. These will be produced by the NLRB.
Poster Compliance Center will publish an updated federal labor law poster with the new NLRA poster for private employers as soon the NLRB issues the official version. This new federal poster will be covered under PCC's OneSystem 1-Year Compliance Plan.
