Class Action Complaint Against General Motors Company Filed By Clark Fountain Law Firm In Response To False Safety Ratings

WEST PALM BEACH, Fla., June 27, 2014 /PRNewswire/ --West Palm Beach-based Clark, Fountain, La Vista, Prather, Keen & Littky-Rubin has filed a Class Action Complaint against General Motors Company (GM) on behalf of its client, Geri Siano Carriuolo, and all persons in Florida who purchased vehicles from GM that contained false and developed safety information. The suit alleges that GM displayed a Monroney sticker on car windows highlighting its 2014 Cadillac CTS Sedan had achieved the highest safety ratings in certain categories by the National Highway Traffic Safety Administration (NHTSA). GM later disclosed to car owners that the vehicles had not received the 5-star ratings. In addition to Clark Fountain, the class action is being represented by South Florida law firms, Shapiro Haber & Urmy LLP and Liggio Benrubi PA.

According to the complaint, through its false representations, GM has violated the Florida Deceptive and Unfair Trade Practice Act (FDUTPA). GM unjustly profited at the expense of the plaintiff and members of the class. In addition, the plaintiff and class members suffered damages due to the significant decrease in automobile value.

"Our client, along with all other innocent consumers, have protection from the state of Florida against automotive companies touting safety claims for this exact reason; not only has GM decreased the value of vehicles for Florida residents, they have given them a false sense of security as safety was clearly a paramount buying decision," said partner, W. Hampton Keen.

In December 2013, Carriuolo purchased a 2014 Cadillac CTS Sedan, which had a standard Monroney sticker representing that the car had achieved 5-star ratings-the highest NHTSA rating available-in three different categories: Frontal Crash Driver, Frontal Crash Passenger and Rollover. Four-and-a-half months later, Carriuolo received a letter from GM stating that the information provided on the Monroney sticker was false, and the 2014 Cadillac CTS Sedan had received no safety ratings.
