NEW YORK, Sept 3 (Reuters) - A federal judge on Friday dismissed part of a criminal case accusing a former Goldman Sachs Group Inc computer programmer of stealing computer code from the bank's lucrative high-frequency trading platform.
The defendant, Sergey Aleynikov, won the dismissal of one count, concerning unauthorized computer access, in a three-count indictment, in a ruling Friday by U.S. District Judge Denise Cote in Manhattan.
Cote rejected Aleynikov's request to dismiss the other two counts, which concerned the alleged theft of trade secrets and transportation of stolen property in interstate commerce.
Kevin Marino, a lawyer for Aleynikov, declined immediate comment, saying he had yet to review the ruling. A spokeswoman for the U.S. attorney's office in Manhattan declined to comment.
